Two Different Types Of Assault

There are two different assault varieties – Simple Assault and Aggravated Assault. The most basic charge is simple assault.

Simple assault is when you attempt to cause or purposely or recklessly cause an injury to another person, you negligently injure someone with a deadly weapon, or you attempt to scare someone with injury by threatening them. This charge is considered a disorderly persons offense and carries a potential penalty of incarceration of up to 6 months and a fine of up to $1,000.00.   If there was a mutual fight, it may be considered a petty disorderly persons offense, and carries up to 30 days in jail. This charge is commonly used when there is a fight between two adults.

Aggravated assault is more serious than simple assault. This charge can be levied if you are believed to have recklessly caused injury to someone with a deadly weapon, you attempted or purposely caused injury with a deadly weapon, you attempted to case injury purposely, knowingly, or in a negligent or reckless manner, or you recklessly pointed a firearm at someone. These charges can be charged as a crime of the second degree, third degree, or the fourth degree. It will be dependent upon the circumstances of the assault and who it was alleged to have been committed against. This is considered an indictable offense and can be punished by as much as 10 years in prison.
